PREAMBLE<\/strong><\/p>\n\n\n\n

The purpose of this regulation is to specify the rights and obligations of clients and collaborators of the firm le Court, tax lawyer (hereinafter: \u00abthe firm\u00bb) concerning the protection of their sensitive personal data.<\/p>\n\n\n\n

CHAPTER I \u2013 PROVISIONS <\/strong>Foreword<\/strong><\/p>\n\n\n\n

Article 1<\/strong> \u2013 <\/strong>But<\/strong><\/p>\n\n\n\n

This regulation aims to govern the protection of sensitive personal data of the firm's clients and employees.<\/p>\n\n\n\n

Article 2<\/strong> \u2013 <\/strong>Definition of personal data<\/strong>the<\/strong><\/p>\n\n\n\n

\u00abSensitive personal data\u00bb means any information relating to an identified or identifiable person, that is, who can be identified, directly or indirectly, by reference to an identifier, such as a name, identification number, location data, an online identifier and one or more factors specific to the physical, physiological, genetic, psychological, economic, cultural, social or intimate sphere of that person.<\/p>\n\n\n\n

Article 3<\/strong> \u2013 <\/strong>Scope of application<\/strong><\/p>\n\n\n\n

This regulation applies to the processing of sensitive personal data held by the firm.<\/p>\n\n\n\n

CHAPTER II \u2013 CONSENT<\/strong><\/p>\n\n\n\n

Article 4<\/strong> \u2013 <\/strong>Customer consent<\/strong><\/p>\n\n\n\n

By entrusting the execution of a mandate to the firm and providing the firm with its sensitive personal data, the client expressly consents to the processing of personal data concerning it that is sensitive.<\/p>\n\n\n\n

Article 5<\/strong> \u2013 <\/strong>Employee consent<\/strong><\/p>\n\n\n\n

Upon concluding an employment contract, employees of the firm expressly consent to the processing of sensitive personal data concerning them.<\/p>\n\n\n\n

2. Each former employee may withdraw their consent to the processing of sensitive personal data at any time by written declaration, subject to data that the law requires to be retained or processed.<\/p>\n\n\n\n

CHAPTER III \u2013 RIGHTS OF THE DATA SUBJECT<\/strong><\/p>\n\n\n\n

Article 6<\/strong> \u2013 <\/strong>Right to information<\/strong><\/p>\n\n\n\n

Subject to professional secrecy, where sensitive personal data relating to a data subject are collected from that data subject or a third party, the controller shall, on request, provide the data subject with information relating to that data, in particular the identity and contact details of the controller, the contact details of the data protection officer, the purposes of the processing for which the sensitive personal data are intended, the recipients of the sensitive personal data, if any, the period for which the sensitive personal data are stored and the rights available to the data subject, in particular the right to lodge a complaint with a supervisory authority.<\/p>\n\n\n\n

2. Subject to professional secrecy, where sensitive personal data are not collected from the data subject, the data subject shall, on request, have the right to know the source from which personal data originating from them come and, where applicable, an indication of whether they originate from publicly accessible sources.<\/p>\n\n\n\n

Article 7<\/strong> \u2013 <\/strong>Right of access<\/strong><\/p>\n\n\n\n

Subject to professional secrecy, the data subject shall, on request, have the right to obtain access to sensitive personal data concerning them and information relating to that data, including the rights mentioned in Article 6(1) of this Regulation.<\/p>\n\n\n\n

Article 8<\/strong> \u2013 <\/strong>Right of rectification<\/strong><\/p>\n\n\n\n

The individual concerned has the right to obtain the rectification of inaccurate sensitive personal data concerning them.<\/p>\n\n\n\n

2. The data subject has the right to have incomplete sensitive personal data rectified.<\/p>\n\n\n\n

Article 9<\/strong> \u2013 <\/strong>Right to erasure and restriction of processing<\/strong><\/p>\n\n\n\n

The data subject may request a restriction on the processing of sensitive personal data concerning them or its erasure, within the limits of the professional obligations of lawyers and provided that applicable legislation allows it.<\/p>\n\n\n\n

CHAPTER IV \u2013 OBLIGATIONS OF THE DATA CONTROLLER<\/strong><\/p>\n\n\n\n

Article 10<\/strong> \u2013 <\/strong>Data controller<\/strong><\/p>\n\n\n\n

1. The study has appointed a Data Protection Officer.<\/p>\n\n\n\n

2. The data controller determines the purposes and means of processing sensitive personal data.<\/p>\n\n\n\n

3. The data controller designated by the study shall implement appropriate technical and organisational measures to ensure compliance with the protection of sensitive personal data.<\/p>\n\n\n\n

4. The controller shall make the necessary communications under this Regulation.<\/p>\n\n\n\n

Article 11<\/strong> \u2013 <\/strong>Subcontractors<\/strong><\/p>\n\n\n\n

The study will use subcontractors who provide sufficient guarantees regarding the implementation of appropriate technical and organisational measures.<\/p>\n\n\n\n

CHAPTER V \u2013 DATA STORAGE<\/strong><\/p>\n\n\n\n

Article 12<\/strong> \u2013 <\/strong>Data storage location<\/strong><\/p>\n\n\n\n

The sensitive personal data of study clients is stored in Switzerland, primarily in a secure IT system, and secondarily in physical documents located in protected areas.<\/p>\n\n\n\n

Article 13<\/strong> \u2013 <\/strong>Data retention period<\/strong><\/p>\n\n\n\n

Sensitive personal data are kept by the study for a period of ten years.<\/p>\n\n\n\n

CHAPTER VI \u2013 FINAL PROVISIONS<\/strong><\/p>\n\n\n\n

Article 14<\/strong> \u2013 <\/strong>Entry into force of this Regulation<\/strong><\/p>\n\n\n\n
